Protecting your personal data is a priority for Maria Home. Below, we describe who we are, the purposes for which we may use your personal data, how we process it, with whom we share it, how long we keep it, and how you can contact us and exercise your rights.
Who Are We?
Your data will be processed by Maria Home.
Maria Home is the data controller within the meaning of the General Data Protection Regulation (hereinafter referred to as the GDPR).
Why Do We Process Your Information?
Your personal data may be collected and processed by Maria Home for the following purposes:
a) To comply with legal obligations to which Maria Home is subject, particularly communications to immigration and border services and invoicing purposes.
b) For the execution of the Temporary Tourist Accommodation Contract or the Local Accommodation Management Contract entered into with Maria Home, particularly payment transactions, management of check-ins and check-outs, guest management, security deposit collection, provision of complementary stay services such as cleaning, transfers, breakfast or grocery services, management of contractual obligations, or pre-contractual procedures.
c) For mobile and email communications containing information and commercial communications, digital platforms, within the scope of Maria Home’s marketing strategies, commercial and contractual communications, as well as responses to information requests.
d) For the protection of property or assets owned by Maria Home, as well as for statistical analysis purposes.
Failure to provide personal data for the purposes described in points (a) and (b) will result in Maria Home being unable to comply with legal obligations and may consequently lead to termination of the Temporary Tourist Accommodation Contract or Local Accommodation Management Contract without any right to compensation, as well as deficiencies in services provided by Maria Home that are not attributable to it.
What Type of Personal Data Do We Collect?
As part of its activity, Maria Home will collect and process the personal data necessary to provide the contracted services, respond to information requests, or manage pre-contractual procedures, namely identification, contact, banking, or payment card data.
On What Basis Do We Process Your Information?
The processing of your personal data is based on the execution of the temporary tourist accommodation contract, the Local Accommodation Management Contract, and compliance with legal obligations imposed on Maria Home, particularly legislation regarding the entry, stay, and departure of foreign nationals within Portuguese territory and tax legislation (Article 6(1)(b) and (c) of the GDPR).
In addition, the personal data collected for the purposes described in point (c) above are based on the consent you have given to Maria Home for such processing (Article 6(1)(a) of the GDPR).
For the purposes described in point (d), Maria Home processes personal data based on its legitimate interests pursued (Article 6(1)(f) of the GDPR).
How Long Do We Keep Your Information?
Without prejudice to legal, regulatory, or judicial requirements to the contrary, the personal data collected will only be retained for the minimum period necessary for the purposes that motivated their collection or subsequent processing.
With Whom May We Share Your Personal Data?
Maria Home may need to share some of your personal data with other recipients. These recipients include:
a) Organizations and/or companies affiliated with Maria Home whenever they comply with an equivalent personal data protection policy.
b) Public entities to which Maria Home is legally required to provide information, particularly Immigration and Border Services and the DGCI – Directorate-General of Taxes.
c) Subcontractors providing certain services related to your personal data under subcontracting agreements and solely for the purpose of providing technical assistance to Maria Home. These include, in particular, website hosting providers, email marketing service providers, cleaning service companies, law firms, accounting firms, and insurance companies.
d) Competent authorities to which Maria Home is legally required to disclose information during legal proceedings or to detect technical and/or security issues, such as judicial entities or competent supervisory authorities.
Are My Data Transferred Outside the European Union?
Your personal data collected by Maria Home will not be transferred to any entity established outside the European Union.
Exceptionally and subject to certain conditions, Maria Home may transfer your personal data to countries outside the European Union territory in accordance with applicable legislation, namely for hosting or data storage purposes, subcontracting technical processing, backup and recovery of hosted data, or service development.
Maria Home assures you that it will not transfer your personal data to countries that do not guarantee an adequate level of protection in accordance with GDPR provisions.
What Are My Rights?
At any time, in accordance with the GDPR, you may request access to your personal data, as well as its rectification or deletion, restriction of processing, the right to object, and the right to data portability.
If requests are manifestly unfounded or excessive, particularly due to their repetitive nature, Maria Home may charge a reasonable fee considering the administrative costs of providing the information or taking the requested measures, or may refuse to comply with the request.
In the case of personal data processed by Maria Home based on your consent, you have the right to withdraw that consent at any time. However, exercising this right does not affect the lawfulness of processing carried out prior to withdrawal nor any subsequent processing based on another legal basis, such as contract performance or compliance with legal obligations to which Maria Home is subject.
You also have the right to lodge a complaint with the National Data Protection Commission.
Security and Confidentiality
We are committed to keeping your data secure and use appropriate security measures to ensure your personal data is protected and to prevent unauthorized access. However, data transmission over the Internet is not completely secure, and we cannot provide an absolute guarantee regarding the security of information transmitted through our website.
We also respect the confidentiality of your information. Therefore, we do not sell, distribute, or otherwise commercially make your information available to third parties. Maria Home undertakes to keep your information confidential in accordance with this Privacy Policy and applicable legislation.
